Big Bend Border Wall: Judge Blocks Construction Region-Wide — Here's What's Open for Your Visit

If you've been following our updates on the border wall story, this is the biggest one yet: a federal judge didn't just pause construction this time. She blocked it outright, region-wide, and ruled the government can't keep skipping the laws it's been waiving to build fast.

Here's exactly what happened, and, more importantly for your trip planning, everything that's open and running in Big Bend right now.

The Ruling: A Preliminary Injunction Out of El Paso

On Friday, October 2, 2026, U.S. District Judge Kathleen Cardone granted a preliminary injunction halting all border barrier and road construction across the entire Big Bend region, not just inside the national park, but the full 500+ mile Big Bend Sector, including Big Bend Ranch State Park.

The ruling came out of the Western District of Texas in El Paso, in a lawsuit brought by the Center for Biological Diversity, Friends of the Ruidosa Church, and a Big Bend-area river guide and landowner, against the Department of Homeland Security, DHS Secretary Markwayne Mullin, and U.S. Customs and Border Protection. Their case argues the federal government's sweeping waiver of environmental and historic preservation laws, used to fast-track the project, went beyond what Congress authorized.

Two things make this ruling bigger than the pause we told you about back in August:

  1. It covers the whole region, not just the national park, including Big Bend Ranch State Park and the broader Big Bend Sector.

  2. The judge ruled the federal waivers themselves are no longer in effect while the injunction stands. That means the government now has to comply with the full slate of laws it had been skipping, things like the National Park Service Organic Act, the Endangered Species Act, and the National Wild and Scenic Rivers Act.

The timing mattered, too. CBP's own administrative pause from mid-August had already expired on September 30. Without this injunction, construction could have resumed at any moment.

What This Means (and Doesn't Mean)

This is still not a final ruling. It's a preliminary injunction, meaning construction stays blocked while the underlying lawsuit works its way through the court. It's a major, concrete win for the plaintiffs, but the case itself isn't over.

What it does mean right now: no bulldozers, no new roads, no barrier construction anywhere in the Big Bend region while this injunction is in place.

What's Actually Open in the Park Right Now

Here's the good news for anyone planning a trip. As of the National Park Service's most recent update, the only closures in Big Bend are weather-related, not construction-related:

  • River Road East and West — closed due to flash flood damage

  • Glen Spring Road (south of Rice Tanks Campsite) — closed, same reason

  • Old Maverick Road — closed, same reason

  • Hot Springs Road — closed, same reason

  • The paved road between Cottonwood Campground and Santa Elena Canyon — closed, same reason (this affects access to the Santa Elena Canyon trailhead via Ross Maxwell Scenic Drive, so check current conditions before heading that way)

  • Black Gap Road — closed, same reason

Everything else is running as normal:

  • Chisos Basin trails — Window Trail, Lost Mine Trail, the Pinnacles, South Rim — no closures reported

  • Panther Junction and Chisos Basin Visitor Centers — open daily

  • Food truck outside the Lodge — open 7am–3pm (closed 10–11am)

  • Boquillas Port of Entry — open Friday–Monday, 9am–4pm (bring your passport)

Flash flood conditions can change fast out here, so always check the NPS Alerts & Conditions page the morning of your visit.

Outfitters and Guided Adventures Still Running

October is genuinely one of the best months to be out here, and the local outfitters are in full swing:

  • Far Flung Outdoor Center — rafting trips on the Rio Grande (from half-day family floats to multi-night expeditions), Jeep tours, and ATV adventures

  • Big Bend River Tours — canoe and raft trips through the Rio Grande's canyons

  • Big Bend & Lajitas Stables — horseback riding, from 2-hour rides to multi-day trips through Big Bend Ranch State Park

  • Desert Sports — mountain biking and paddling trips

  • Angell Expeditions — backcountry hiking and river trips

  • The Saddle & Paddle combo (Lajitas Stables + Big Bend River Tours) — half a day on horseback, half a day floating the river. It's only offered September through April, so fall is exactly the right time to book it.

Coming Up: Terlingua Music Bash, October 15–18

Mark your calendar: the 31st annual Terlingua Music Bash rolls into Terlingua Ghost Town October 15–18, 2026. It's four days and nights of live music, song circles, and desert community spirit, and it's free, with no tickets required at any venue.

The Bash started back in the '90s when a couple of musicians from Central Texas made an annual trek out to Terlingua to play with the locals, and decades later it's still going strong. There's a silent auction too, with proceeds benefiting the Mark (eYeBall) Kneeskern Memorial Scholarship for Terlingua CSD kids.

If you're planning a fall trip, this is the week to do it — stay with us and walk into the heart of the Bash from your home base just minutes away.

The Bottom Line

The wall fight isn't over, but for the moment, the region has a real, enforceable court order stopping construction while the case plays out. And for your trip? Big Bend is open, the trails are calling, the river's running, and fall is arguably the best season to be here.

We're three miles from the park's west entrance — come stay with us and we'll help you sort out the best way to spend your time, wall news and all.
